ENVIRON Webinars Explain EU WEEE, Batteries and Packaging Enforcement

Compliance with EU environmental regulations continues to be actively enforced by Member State regulatory authorities, with stringent penalties for companies who fail to meet their obligations in each country. The EU Directives on WEEE (Waste Electrical and Electronic Equipment), Batteries and Packaging, place responsibility on producers to register with the regulatory authorities and provide collection, recycling and reporting arrangements in each country for each of these items at end-of-life.

Between 1st August 2013 and 31st January 2014, the UK Packaging Enforcement Authority issued 20 Enforcement Undertakings. A food manufacturer was fined £414k, a cosmetics company was fined £191k and a winery was fined £156k.

In 2012 the Irish Environmental Protection Agency (EPA) prosecuted an electric bike company for three WEEE offences including failure to register as a WEEE producer and failing to report the quantities of equipment they had placed on the market. Details of the prosecution, including the company name are published on the EPA website. In 2009 the German Enforcement Authority issued a EUR 120,000 fine (later reduced to EUR 22,500) to an online distributor for failing to comply with WEEE reporting requirements in Germany.

In 2014 the UK Battery Enforcement Agency is inspecting battery producers' websites to check that they provide appropriate take-back arrangements for waste batteries. To date, 331 websites for producers of industrial and automotive batteries have been inspected and only 18 of these have been found to provide adequate waste battery take-back information.
